By signing up for one of HubHost.com (further referred to as "We", "Us" or "Our") hosting plans (further referred to as "Service", "Services", "Subscription", "Account" or "Accounts"), you ("You", "Customer", "Customers") agree to be bound by the Terms of Use. The Terms of Use agreement supersedes any and all statements, claims, offers and/or warranties expressed or implied or interpreted by You to be expressed or implied on any other page on this web site.

1) All Accounts will be set up upon receipt of payment for Services provided. Applicable fees are due in advance of the Services provided. You are responsible to insure that Your Account is in good standing. For uninterrupted Service You should make sure that Your fees are paid at least one month prior to the expiration of Your current Service. Failure to pay consequent Service fees (i.e. for the next Service period) may result in termination of Your Services without notice. HubHost.com shall not be liable for any loss due to termination of Service.

2) If You cancel Your Service within 30 days of the sign up date, You will be refunded your payment, less a cancellation fee of $25.  Domain registration fees are non-refundable.  Sign up date is the date we e-mail you your web site set up information (IP#, user ID and password).  Your refund will be issued after we are completely satisfied that You are no longer using our Services. If You cancel Your Service, You are responsible for immediately removing Your site from our servers. If You fail to do so, HubHost.com reserves the right to remove Your site without being held responsible or liable for any loss or damages whatsoever. Moreover, HubHost.com reserves the right to withhold your refund and/or to bill You until we are satisfied that You are no longer using our Services. If cancellation is caused by Customer's violation of HubHost.com Terms of Use or any other HubHost.com policies, no refund will be issued.  

You are responsible for forwarding of Your renewal fees at least 30 days prior to expiration of Your current Service period.  We will attempt to notify You be e-mail, however We do not guarantee that we will send You a renewal notification, nor do we guarantee that You will receive it before Your renewal fees are due.  In case that You do not receive renewal notification from Us, or that the notification is late, You are still required to forward Your renewal payment on time, as outline above.  If renewal fees are not received prior to expiration of Your Service period, We reserve the right to terminate Your account without notification.

Accounts over limit will be allocated additional server space equal to (or greater if requested by You) Your original server space order.  You agree to use web space assigned to You up to the allowable limit (as indicated on Your order form).  In case that Your Account exceeds assigned amount of server space You agree that You will forward required fees as soon as notified by Us.  Failure to forward required fees within 15 days of notification will result in suspension and/or termination of Your account.  Once Your account is suspended or terminated a fee of $25 will be assessed if you wish to reactivate Your account.  If Your account is suspended or terminated and you wish to reactivate it, we will review Your case, however, we reserve the right to reject to reactivate Your account if we see fit to do so.  If your cheque cannot be cashed due to insufficient funds in your account, You will be assessed a $25 NSF fee.  We reserve the right to deactivate your account until all outstanding fees are paid.

3) HubHost.com makes no warranties of any kind, express or implied, including warranty of merchantability or fitness for a particular purpose for the Service it is providing. HubHost.com cannot guarantee continuous Service, Service at any particular time, or integrity of data stored or transmitted via its system or via the Internet. HubHost.com will not be liable for any corruption, disclosure or loss of data transmitted or received or stored on its system. HubHost.com shall not be liable to Customer for any claims or damages which may be suffered by Customer, including, but not limited to, loss of data resulting from delays, non-deliveries, misdeliveries, or Service interruptions caused by its own negligence, Customer's errors or omissions, or due to the fault of third parties.

HubHost.com shall not be liable to Customer for any claims or damages which may be suffered by Customer resulting from failure to forward renewal fees or additional server space fees.  HubHost.com shall not be responsible for preservation or custody of Customer's web content in case of termination of Service.  

4) Services provided to the Customer by HubHost.com may only be used for lawful purposes. Transmission or publication of any information, data or material in violation of any applicable local, provincial, national or international law, is strictly prohibited. This includes, but is not limited to, materials protected by copyright, use or transfer of obscene material, child pornography, pirated software, hate materials, any materials associated with any illegal activity, etc... HubHost.com reserves the right to immediately terminate Service to Customer without notice or liability for actual, compensatory or consequential damages to Customer for the interruption in Service.

5) Customer agrees to defend, hold harmless and indemnify HubHost.com, its officers and employees, from any demand, liability, claim, loss, damage or expense arising out of or result from any Services provided and resulting from the Customer's use of HubHost.com Services.

6) Domain Registration Terms:

General
Domain registration fees are non-refundable.  Domain names are registered by HubHost.com and provided for Your use with Your web site hosting Account for the duration of the Service.  HubHost.com is not a registered domain name registrar, however we are affiliated with an US accredited wholesale registrar.

If you decide not to renew Your hosting Service with Us, we will not renew your domain name registration.  If you wish to keep your domain name, we can assist you in transferring it to another registrar.  You agree to assume any and all costs associated with Your domain transfer and future registration.

Limitation of Liability
By asking us to register a domain name, you agree that you alone will assume all risks, responsibilities and liabilities that may arise from the domain registration process, some of which may include, but not limited to (a) any errors made by you or by us during the registration process, (b) suspension, loss or cancellation of your domain name by us or by a third party, (c) use of your domain name, (d) infringement upon any intellectual or legal rights of a third party, and (e) any other events not specifically mentioned herein.

Warranty
HubHost.com provides domain registrations to our customers on "As Is" basis. By using our domain registration Service, you acknowledge understanding that we are not accredited or approved domain name registrar, rather we provide this Service to simplify setup of your web hosting Account.

7) The use of Services, materials or information provided by HubHost.com, is at Customer's sole and absolute risk.  We reserve the right to change and/or amend these Terms of Use, as well as any other web pages on our web site from time to time without notification to our Customers.
